SPECIFIC RENTAL CONDITIONS “La Maison d’à Côté”
​
Article 1 - The best welcome will be reserved for guests. The owner undertakes to ensure personally their welcome with all the desirable attentions to facilitate their stay and the knowledge of the region.


​Article 2 - Duration of stay: The customer signing this contract concluded for a fixed period (minimum two nights) may not under any circumstances claim any right to remain in the premises.


​Article 3 - The prices are inclusive of all charges, excluding additional services such as tourist tax and “cleaning and service charges” package. For long-term stays during the “winter” period (December 1 to April 1), a contribution to energy costs will be negotiated. For child rates under 16, contact the owner. ​


Article 4 - Conclusion of the gîte contract “La Maison d´à Côté”: the reservation becomes effective when the tenant has sent the owner an amount representing 30% of the total rental amount. The balance must be paid at least 3 days before the date of arrival.

Article 5 - Absence of withdrawal: for reservations made by mail, by
telephone or online, the tenant does not benefit from the withdrawal period, and this
in accordance with Article L.221-28 (12°) of the Consumer Code relating in particular to the provision of accommodation services provided on a date or according to a determined frequency.


​Article 6 - Cancellation by the customer: any cancellation must be notified by registered letter addressed to the owner - Cancellation before the start of the stay: if the cancellation occurs more than 30 days before the start of the stay, a refund of 25% of the amount of the stay will be made - If the cancellation occurs less than 30 days before the start of the stay, the deposit or payment will remain with the owner

 

- If the cancellation occurs less than 48 hours before the duration of the stay or if the customer does not show up before 8 p.m. on the day scheduled for the start of the stay, the deposit will remain lost and the owner will also claim the balance of the price of the stay only in the event of payment of a deposit- In the event of a shortened stay, except in the event of force majeure*, the price corresponding to the initial stay remains fully acquired by the owner.


*Cancellation in case of force majeure. In the event of cancellation by the customer due to force majeure, the reservation will be valid for another date. In case of refusal on the part of the customer to postpone, the special rental conditions apply


​Article 7 - Cancellation by the owner.

When before the start of the stay (more than 72 hours), the owner cancels this stay, he must inform the client by registered letter with acknowledgment of receipt. In the case of a cancellation less than 72 hours before the start of the stay, the owner or a person representing him may cancel by telephone. In both cases, the deposit or payment will then be refunded to the customer.

​Article 8 - Arrival: the customer must arrive on the specified day and at the times mentioned on this contract or booking confirmation. In case of late or delayed arrival, the customer must notify the owner (06 50 26 81 55 or by email anneallenjoie@gmail.com).


​Article 9 - Tourist tax: The tourist tax is a local tax that the customer must pay to the owner who then pays it to the public treasury (€2 per person in January 2023)


​Article 10 - Use of the premises: the customer must respect the peaceful nature of the premises and make use of them in accordance with their destination. He undertakes to return the gîte in good condition, tidy and clean. The organization of parties and events is prohibited. The occasional reception of guests, without sleeping arrangements and in limited numbers, must be announced and negotiated with the owner.


​Article 11 - Capacity: This reservation or contract or invoice is established for a specific number of people. If the number of customers exceeds this number, the owner is able to refuse the additional customers.


Article 12 - Animals: This contract specifies that the customer cannot stay in
company of a domestic animal. In the event of non-compliance with this clause by the client, the owner may cancel the stay, without this being considered as a
modification or termination of the contract at the initiative of the owner 

so that in case of departure of the customer no refund can be considered.


​Article 13 - the cottage is non-smoking. A smoking area, on the outdoor terrace, is at
disposal with an ashtray.


​Article 14 - To respect the tranquility of the premises and the guests, please do not let the children run or shout.


​Article 15 - Disputes: Any legal action may be brought by the customer or the owner with the Tribunal de Grande Instance of MONTBELIARD, Cité Judiciaire, rue Mozart 25200 MONTBELIARD.


​Article 16 - Deposit. A check for €800 (eight hundred euros) will be requested as a deposit, will be returned to the customer within 1 month (departure of mail) minus the amount of
possible damage (damaged bedding, disappearance or breakage of furniture or objects)


​Article 17 - Insurance. The tenant undertakes to take out insurance against rental risks (fire, water damage). The lack of insurance, in the event of a claim, will give rise to damages. The owner undertakes to insure the accommodation against rental risks on behalf of the tenant, the latter having the obligation to notify him, within 24 hours, of any disaster occurring in the accommodation, its outbuildings or accessories.

Article 18 - The tenant cannot oppose the visit of the premises, when the owner or his representative so requests.


​Article 19 - No compensation may be claimed by the reservee(s) in the event of
accident or in the event of equipment failure. The owner undertakes to maintain the perfect functioning of the equipment or to repair it as soon as possible, if necessary.


​Article 20 - Arrival times are set between 3 p.m. and 10 p.m. Departures must take place at 10am at the latest.​
